These Terms of Service (“Terms”) govern access to and use of petrutban.com and any pages, documentation, demos, forms, materials, APIs, or services published under the Petrutban Technologies brand, including QEVARO pages and materials (collectively, the “Service”).
By accessing or using the Service, you confirm that you have read, understood, and accept these Terms. If you do not agree, do not use the Service.
1) DEFINITIONS
- “Petrutban Technologies” – the brand name under which projects, documentation, and technical updates are published (“Operator”).
- “QEVARO” – an AI assistant project in development (pre-release), published with documentation and public updates.
- “Content” – text, graphics, logos, UI, documentation, files, code, videos, demos, and any other materials available in the Service.
- “You” / “User” – anyone who accesses the Service.
2) SERVICE PURPOSE AND STATUS (IMPORTANT)
- The Service is published primarily for information, documentation, project updates, and progress presentation.
- QEVARO is in pre-release / active development. Features, availability, performance, interfaces, and technical details may change at any time.
- We do not provide SLA (service-level agreement) guarantees for pre-release parts unless explicitly stated otherwise in writing.
3) ELIGIBILITY AND MINORS
- The Service is not intended specifically for children under the applicable digital consent age in the EU/your country.
- If you are under 16, you may use the Service only with a parent/guardian’s consent and supervision where law requires parental consent for online services and data processing.
- By using the Service, you declare that you meet the eligibility conditions above.
4) ACCOUNTS, CONTACT, AND COMMUNICATIONS
- Some parts of the Service may work without an account.
- If you provide a contact email or write to us, you agree to receive administrative responses (e.g., support, security, clarifications).
- You are not required to publish a phone number publicly. For correspondence or third-party verifications (e.g., platforms), it may be requested separately depending on the platform.
5) ACCEPTABLE USE
You agree NOT to:
- violate applicable laws/regulations;
- attempt unauthorized access to systems, accounts, servers, APIs;
- disrupt or degrade the Service (aggressive scans, DDoS, spam, excessive scraping);
- bypass security measures or technical restrictions;
- use the Service for fraud, deception, impersonation, phishing, or malware distribution;
- copy, modify, redistribute, or sell Content without authorization (except where explicitly allowed by separate open-source licenses).
We may restrict access if we detect abuse or non-compliant use.
6) INTELLECTUAL PROPERTY
- Service Content belongs to the Operator or its licensors and is protected by copyright and other laws.
- You do not gain any ownership rights to Content by using the Service.
- You may quote short excerpts from documentation for informational purposes with attribution (link to the official page), unless expressly prohibited on that page.
- If we publish code under an open-source license, that code is governed by its license (not this section), and the license will be shown clearly in the repository/page.
7) QEVARO AND AI OUTPUTS
- If the Service includes demos or AI features, outputs may be inaccurate, incomplete, or unsuitable for your case.
- Do not rely on AI outputs as professional advice (medical, legal, financial, safety). Verify independently.
- You use AI outputs at your own risk. If we publish additional usage rules for QEVARO (e.g., anti-abuse policies), they apply in addition to these Terms.
8) PRIVACY, DATA, AND COOKIES
- How we handle data is described in the Privacy Policy published on the site.
- If the Privacy Policy conflicts with these Terms regarding data, the Privacy Policy prevails for those aspects.
- We may use security measures and technical logs (e.g., for abuse prevention and troubleshooting) as described in the Privacy Policy.
9) THIRD-PARTY LINKS
- The Service may contain links to third-party sites (e.g., GitHub, YouTube, external documentation).
- We do not control or guarantee third-party content/services. Their use is governed by their terms.
10) AVAILABILITY, CHANGES, AND INTERRUPTIONS
- We may modify, suspend, or discontinue the Service (in whole or in part) at any time, including for maintenance, security, or product changes.
- We do not guarantee uninterrupted or error-free Service availability, especially for pre-release components.
11) DISCLAIMER OF WARRANTIES
- The Service is provided “as is” and “as available”.
- To the extent permitted by law, we disclaim implied warranties (e.g., merchantability, fitness for a purpose, non-infringement).
- We do not guarantee specific results, rankings, indexing, or automatic visibility in search engines or third-party platforms.
12) LIMITATION OF LIABILITY
- (a) indirect, incidental, special, or consequential losses;
- (b) loss of data, profit, reputation, or opportunities;
- (c) decisions made based on Content or AI outputs;
- (d) Service unavailability or errors.
If we are nonetheless found liable, total liability (to the extent permitted by law) is limited to the amount you paid to the Operator for the Service in the last 12 months; if you paid nothing, the limit is 0.
13) INDEMNITY
You agree to indemnify the Operator for claims/damages arising from:
- (a) violating these Terms;
- (b) illegal or abusive use of the Service;
- (c) infringement of third-party rights.
14) TERMINATION / ACCESS TERMINATION
- (a) you violate these Terms;
- (b) there is a security risk or abuse;
- (c) it is required for legal compliance.
Sections that by their nature should survive (e.g., Intellectual Property, Disclaimer, Limitation of Liability) remain in effect.
15) CHANGES TO TERMS
- We may update these Terms periodically.
- The “Last updated” date will change. Continued use after the new version is published means acceptance.
16) GOVERNING LAW AND DISPUTES
- These Terms are governed by Romanian law and EU law to the extent relevant.
- Disputes are resolved by the competent courts in Romania unless law requires a different forum.
